Section 92(1) of the Constitution of Saint Lucia establishes the Teaching Service Commission, comprising a chairperson and two to four other members appointed by the Governor General on the Prime Minister’s advice, following consultation with the Leader of the Opposition. This Commission is a constitutionally created, independent body not subject to external influence, as affirmed in Section 92(12). Its primary powers, outlined in Sections 93(1) and (3), include appointing, disciplining, and removing individuals from teaching-related public service positions, excluding those covered by Section 87. The Commission also holds the authority to confirm appointments. These roles apply strictly to positions within schools or school administration. Furthermore, Section 93(2) allows the Commission to delegate its powers in writing, either to its members or, with the Prime Minister’s consent, to public officers. This structure ensures both accountability and autonomy. The constitutional entrenchment of its functions protects the integrity of the education sector. Through these provisions, the Commission operates as a safeguard against political interference in educational appointments and discipline.
